Terms of Service

These Terms of Service (“Terms”) govern your use of equipfundpartners.com (the “Site”), operated by Equipment Fund Partners (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. We are a broker, not a lender
Equipment Fund Partners is an independent equipment finance and leasing broker. We arrange financing through third-party lenders, lessors, and funding sources. We are not a bank, lender, or lessor, and we do not make credit decisions or fund transactions ourselves. Nothing on the Site is a commitment to lend or an offer of credit. All financing is subject to credit review and approval by the applicable lender or lessor, and to that party’s final documentation, rates, terms, conditions, and fees.
2. Informational purposes only
Content on the Site, including descriptions of financing programs, terms, timelines, approval speeds, lender counts, and industries served, is provided for general informational purposes and is subject to change without notice. Rates, structures, and terms vary by transaction, credit profile, equipment type, and lender. Statements about approval times or funding speed are estimates and are not guarantees.
3. No professional advice
Nothing on the Site constitutes legal, tax, accounting, insurance, or investment advice. Consult your own advisors before entering into any financing or lease transaction.
4. Applications and submitted information
If you submit an inquiry or credit application, you represent that you are at least 18 years old, that you are authorized to act on behalf of the business identified, and that all information you provide is true, accurate, and complete. You authorize us to submit your information to lenders and funding sources and to obtain credit information as described in our Privacy Policy. You agree to notify us promptly of any material change to the information you submitted.
5. Electronic communications and consent to contact
By providing your email address or telephone number, you consent to receive communications from us by email, telephone, and text message regarding your inquiry, including at any wireless number you provide. Message and data rates may apply. You may opt out of marketing communications at any time; we may still contact you about an active application. You agree that electronic communications and electronic signatures satisfy any legal requirement that a communication or signature be in writing.
6. Acceptable use
You agree not to use the Site to submit false, fraudulent, or unauthorized information; to submit another person’s information without authorization; to attempt to gain unauthorized access to the Site or its systems; to introduce malicious code; to use automated means to extract data from the Site; or to use the Site in violation of any applicable law.
7. Intellectual property
The Site and its content, including text, graphics, logos, and the Equipment Fund Partners name and marks, are owned by us or our licensors and protected by applicable law. You may view and print Site content for your own internal business use. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent.
8. Third-party sites and providers
The Site may contain links to third-party websites and may reference third-party lenders, insurers, and service providers. We do not control and are not responsible for their content, products, services, or acts or omissions. Your dealings with any third party are solely between you and that party.
9. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the fullest extent permitted by law, Equipment Fund Partners and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost data, arising out of or relating to your use of the Site or any financing inquiry, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Equipment Fund Partners and its owners, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your breach of these Terms, or information you submitted that was false, inaccurate, or submitted without authorization.
12. Governing law and venue
These Terms are governed by the laws of the State of Connecticut without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hartford County, Connecticut, and you consent to the personal jurisdiction of those courts
13. Changes to these Terms
We may modify these Terms at any time by posting the revised version on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance.
14. Independent Representatives and Referral Partners
Equipment Fund Partners works with independent brokers, sales representatives, and referral partners. These individuals are independent contractors, not employees, agents, or partners of Equipment Fund Partners or any lender or insurer. No representative may approve credit, guarantee financing, sell or bind insurance, or change the terms of any lender’s offer. Only the lender’s final written documentation governs a transaction
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and us regarding the Site.
